Today, in response to questioning from Rep. Jared Polis, Education Secretary Betsy DeVos struggled to answer basic questions, did not know that transgender students are protected by rulings in Whitaker v. Kenosha and Glenn v. Brumby and said that the Department of Education would not uphold circuit court rulings protecting transgender students without a mandate from Congress or the Supreme Court. This comes as a court in Virginia ruled today that that federal law protects transgender students from being forced to use separate bathroom facilities.

“The courts have been clear: federal law protects transgender students from discrimination,” said DNC LGBTQ Media Director Lucas Acosta “Secretary DeVos is flouting federal law to advance her far-right social agenda, which is out of step with judicial precedent and American values. All of our students deserve a government that looks out for their best interests and will fight for them regardless of their sexual orientation or gender.”
